Terms of Service

1. Agreement

These Terms govern your access to and use of PermitSpark (the “Service”). By creating an account or using the Service you agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

2. The Service

PermitSpark aggregates public building-permit records and provides search, alerts, integrations, and analytics. We strive for accuracy but the underlying data originates from third-party government sources and may contain errors, omissions, or delays. The Service is provided for lead-generation and informational purposes and is not legal, financial, or professional advice.

3. Public-records data and acceptable use

Permit data derives from public records. You agree to use it lawfully and responsibly. You will not:

• Use the data for unlawful discrimination, harassment, or stalking of any person.
• Use it to make eligibility decisions governed by the FCRA (credit, insurance, employment, housing).
• Resell, redistribute, or scrape bulk data except as expressly permitted by your plan (e.g. the v2 Data API).
• Contact individuals in violation of CAN-SPAM, TCPA, Do-Not-Call, or similar laws.
• Attempt to re-identify or aggregate redacted/block-level data to defeat our access tiers.

We may suspend accounts that misuse the data or violate source terms.

4. Accounts and security

You are responsible for safeguarding your credentials and for activity under your account. Notify us immediately of unauthorized use. We offer two-factor authentication and passkeys, which we strongly recommend enabling.

5. Subscriptions, billing, and trials

Paid plans renew automatically each billing period (monthly or annual) until canceled. Annual plans are billed up front and include two months free relative to monthly pricing. You authorize us and our payment processor to charge your payment method. You can cancel anytime from your billing settings; access continues through the end of the paid period. Except where required by law, fees are non-refundable. We may change prices with notice effective at your next renewal.

6. Integrations

When you connect third-party services (CRMs, webhooks, Zapier/Make), you authorize us to exchange data with them on your behalf. Your use of those services is governed by their own terms, and we are not responsible for them.

7. Intellectual property

We retain all rights in the Service, including our software, classifications, enrichments, and presentation. Underlying public records are not owned by us. You receive a limited, non-exclusive, non-transferable right to use the Service per your plan.

8. Disclaimers

THE SERVICE AND DATA ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE DATA IS COMPLETE, ACCURATE, OR TIMELY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMITSPARK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or data, or your violation of these Terms or applicable law.

11. Termination

You may stop using the Service anytime. We may suspend or terminate access for violations of these Terms. Sections that by their nature should survive termination will survive.

12. Governing law and changes

These Terms are governed by the laws of the United States and the state in which we are organized, without regard to conflict-of-laws rules. We may update these Terms; material changes will be posted with a new date, and continued use constitutes acceptance.
